Northumberland County Overview
Northumberland County Circuit Court Clerk
The Circuit Court Clerk's Office in Heathsville is where marriage licenses are issued and all official marriage records are stored in Northumberland County. Both parties must appear in person to apply for a license. After the wedding, the officiant returns the completed license to the clerk's office, and that document becomes the permanent marriage record. Staff at the clerk's office can search records by name and date and provide copies of documents on file.
Northumberland County sits on the Northern Neck peninsula, a rural area between the Potomac and Rappahannock rivers. The county was founded in 1648 and holds some of the oldest marriage records in Virginia. Its colonial-era documentation makes it a significant county for historical research. For records before 1936, the clerk is your primary source. Many early records have also been preserved through the Library of Virginia, which keeps colonial marriage records for the county in its collections.

Marriage License Requirements
To apply for a marriage license in Northumberland County, both people must go to the clerk's office together. You do not have to live in Northumberland County to apply there, but the marriage must take place in Virginia. Each person needs a valid government-issued photo ID and their Social Security number. Anyone who has been previously married must provide information on how and when that marriage ended.
Under Code of Virginia § 20-14, Virginia sets clear standards for what is required before a marriage license can be issued. The license is valid for 60 days after the clerk issues it. There is no waiting period. If the ceremony does not happen within 60 days, the license expires and you will need to apply again. After the wedding, the officiant has a legal obligation to return the license to the clerk within 5 days of the ceremony. That returned and signed license is then recorded and becomes the official county marriage record.
Note: The clerk cannot accept photocopies of IDs. Bring original documents or certified copies of any prior divorce decrees or death certificates.

When you order from VDH, you need the names of both parties, the county where the marriage happened, and the approximate year. A copy of your ID and payment must also be included.

Public Access to Northumberland Marriage Records
Virginia law makes marriage records public after 25 years. Marriages from 2000 and earlier are open to anyone. You do not need to be related to the parties or explain why you want the record. For marriages in the last 25 years, access is more limited. Only the parties themselves, their lawyers, or people with a clear legal need can request those records. Both the county clerk and VDH apply these rules when responding to requests.
Virginia's FOIA statute at Code of Virginia § 2.2-3704 gives the public broad rights to request records held by state and local government offices. Marriage records that have passed the 25-year mark fall into the public category under that law. A written request to the clerk is the standard approach. Under Code of Virginia § 32.1-271, restricted vital records can only go to qualified applicants during the protected period.

Virginia Marriage Records Law
Virginia's marriage record system works through a combination of county clerk offices and the state vital records office. Each clerk issues and stores local records, and a copy goes to VDH to build the statewide index. Under Code of Virginia § 32.1-273, the state registrar is responsible for maintaining that index and ensuring records are preserved. This two-part system gives requesters two potential sources for any given marriage record.
