Getting a Marriage License in Buchanan County

Both parties must appear together at the Circuit Court Clerk's office to apply for a marriage license. Neither person can send a representative or apply by mail. You both need valid government-issued photo ID such as a driver's license or passport. If you were previously married, bring proof of how that marriage ended: a divorce decree or a death certificate.

Under Virginia Code § 20-13, a valid marriage license is required before a lawful ceremony can take place in Virginia. The license is valid for 60 days. There is no waiting period after it is issued, and there is no state residency requirement. The minimum age to marry in Virginia is 18. The application form under Code § 20-16 asks for both parties' full legal names, ages, and home addresses.

After the ceremony, the officiant must return the signed license to the Buchanan County Circuit Court Clerk within five days, per Virginia Code § 20-20. The clerk then records the marriage and submits a monthly report to the Virginia Department of Health under Virginia Code § 32.1-267. This creates the state-level record held in Richmond.
