Getting a Marriage License in Powhatan County

Both people who want to marry must appear at the clerk's office together to apply. You do not have to be a Powhatan County resident to apply there, but the ceremony must take place in Virginia. Each applicant needs a valid government-issued photo ID and their Social Security number. Anyone who has been previously married must provide documentation showing how and when that prior marriage ended.

Virginia law under Code of Virginia § 20-14 sets the standards all county clerks follow when issuing marriage licenses. The license is valid for 60 days from the date issued. There is no waiting period. If the wedding does not take place within that window, the license expires and you have to apply again. After the ceremony, the officiant must return the completed and signed license to the Powhatan County clerk's office. That document is then filed as the official county record of the marriage.

Note: The clerk's office requires original documents or certified copies. Plain photocopies of IDs or prior divorce records will not be accepted.
