Getting a Marriage License in Orange County

Both parties must show up at the clerk's office together to apply. Neither needs to be an Orange County resident. The marriage, however, must take place somewhere in Virginia. Each person must bring a valid government-issued photo ID and their Social Security number. If either person has been married before, bring documentation showing how and when the prior marriage ended.

Under Code of Virginia § 20-14, Virginia sets minimum requirements for marriage license applications statewide. The license the clerk issues is valid for 60 days and can be used anywhere in Virginia. There is no waiting period. If the wedding does not happen within 60 days of issuance, the license expires and you need a new one. After the ceremony, the officiant must return the signed license to the clerk's office, and that completed document becomes the official record stored in Orange County.

Note: The clerk does not accept photocopies of IDs. Bring original documents or certified copies if you need to show prior divorce records or a spouse's death certificate.

The Virginia Department of Health Vital Records Office holds certified copies of marriage records for Orange County events from 1936 to the present. You can order copies by mail, online, or in person at VDH's office located at 2001 Maywill Street in Richmond. The fee is $12 per certified copy, and each additional copy ordered at the same time costs $12 as well. Mail orders take about two to four weeks. Going to the county clerk directly is faster if you need a copy right away.

Under Code of Virginia § 32.1-267, marriage records are classified as vital records and the state is responsible for keeping them. Each county clerk sends copies of issued licenses to VDH to build and maintain the statewide vital records file.
