Bath County Marriage License Process
Both people getting married must appear at the Circuit Court Clerk's office to apply for a license. Neither can send a representative. Both must bring valid government-issued photo ID. A driver's license, passport, or state ID card will work. If either person was previously married, bring documentation of how that marriage ended -- a divorce decree or death certificate.
Virginia law under Code § 20-13 requires a valid marriage license for every legal marriage in the state. The license is valid for 60 days and there is no waiting period after it is issued. The minimum age to marry is 18. There is no residency requirement -- out-of-state couples can get a license in Bath County as long as the ceremony will be held in Virginia.
The application process is covered by Virginia Code § 20-16. Both parties complete the application, which includes their names, ages, birthplaces, and address. After the ceremony, the officiant must return the completed license to the Bath County Circuit Court Clerk within five days under Virginia Code § 20-20. The clerk then reports the marriage to the state each month as required by Virginia Code § 32.1-267.
Bath County Marriage Record Copies
You can get a certified copy of a Bath County marriage record from either the local Circuit Court Clerk or from the Virginia Department of Health. The state office holds records for marriages that took place from 1936 forward. For marriages before 1936, the clerk's office is your main source.
To request from the state, contact the Virginia Department of Health Office of Vital Records. The address is 8701 Park Central Drive, Suite 100, Richmond, VA 23227. You can also send requests by mail to P.O. Box 1000, Richmond, VA 23218-1000. The phone is (804) 662-6200. Office hours are Monday through Friday, 7:00 AM to 4:00 PM. The fee for a certified copy is $12 per copy under Virginia Code § 32.1-273.
Only immediate family members can get certified copies of recent records. That includes the couple, their parents, children, siblings, and grandparents, as defined in Virginia Code § 32.1-271. Records older than 25 years are fully public. You must show valid ID -- the VDH ID requirements page lists accepted forms. Certified copies under Virginia Code § 32.1-272 are legally valid documents bearing the state seal.
Historical Bath County Marriage Records
Bath County's marriage records go back to 1790 when the county was formed. The Library of Virginia in Richmond holds many of these historical records, including marriage bonds and registers from the 1800s. These are open for public genealogical research. The Library has digitized a portion of its holdings and made them searchable online.
Because Bath County borders West Virginia (formerly part of Virginia before 1863), some family research may cross state lines. Records for areas that are now in West Virginia are held separately. The Library of Virginia's reference staff can help sort out which records fall where and how to access them. The Bath County Historical Society is another local resource that may have transcribed records or other research tools.
Virginia Department of Health Vital Records
