Getting a Marriage License in Emporia

To get a marriage license in Emporia, both parties must appear in person at the Greensville County Circuit Court Clerk's office. Bring a valid photo ID. If either person has been married before, bring a certified copy of the divorce decree or a death certificate for the former spouse. Virginia sets the minimum marriage age at 18. Under Virginia Code § 20-14, the clerk issues the license. There is no waiting period in Virginia, and the license is valid for 60 days from the date it is issued.

After the marriage ceremony, the officiant signs the license and returns it to the clerk's office. The clerk records the marriage and forwards a copy to the Virginia Department of Health under Virginia Code § 32.1-267. Call (434) 348-4215 before visiting to confirm the current license fee and any specific ID requirements. Some localities in Virginia charge different amounts, so it is worth asking in advance.

For marriages from 1936 onward, the Virginia Department of Health Vital Records issues certified copies for $12 per record under Virginia Code § 32.1-273. Fill out form VS6 and send it with a photo ID copy and payment to VDH at 2001 Maywill Street, Suite 101, Richmond, VA 23230. Requests can also be submitted online through the VDH portal.

For marriages before 1936, contact the Greensville County Circuit Court Clerk at (434) 348-4215. Marriage records for the area start in 1781, so the clerk can assist with historical requests as well. The Library of Virginia holds birth and death records from 1853 to 1896 and marriage records from 1853 to 1935, which can help when you do not know the exact date of a marriage in the area.

Under Virginia Code § 32.1-271, marriage records are restricted for 25 years from the date of the event. After that they become public. Before the 25-year mark, only the named parties, immediate family, or those with a documented legal need can request the records.

Historical Marriage Records in Emporia

Greensville County was created on February 1, 1781 from Brunswick County. Marriage records start in 1781 and land and probate records from the same year are on file. Divorce and court records start in 1900. Emporia became an independent city in 1967 but retained the shared court structure, which means all records for the area both before and after 1967 are in the same place.

FamilySearch has a Greensville County Virginia genealogy index at familysearch.org. This page explains what records exist, what has been digitized, and how to access them. The Library of Virginia also holds older marriage records for this region and can be contacted for research assistance. Researchers working on pre-1900 family trees in the Emporia area will find both of these resources helpful before ordering official copies from the clerk.

Because Emporia and Greensville County share their court, researchers only need to contact one office for records covering both the city and the surrounding area. This simplifies the process compared to other Virginia cities where the city and county maintain separate court systems.

Note: The Library of Virginia houses birth and death records from 1853 to 1896 and marriage records from 1853 to 1935 for this area.
