Getting a Marriage License in Buena Vista

To get married in Buena Vista, both parties must appear in person at the Rockbridge County Circuit Court Clerk's office. You each need a valid photo ID and proof of age. Under Virginia Code § 20-14, the clerk is responsible for issuing all marriage licenses within the jurisdiction. Both applicants must be at least 18 years old. If either party was previously married, bring a certified copy of the divorce decree or a death certificate for the former spouse.

Virginia has no waiting period before the license becomes valid. Once issued, the license is good for 60 days from the date of issue. The ceremony must take place in Virginia within that window. After the ceremony, the officiant returns the completed license to the clerk's office. The clerk then records the marriage and forwards a copy to the Virginia Department of Health under Virginia Code § 32.1-267.

Note: Fees for marriage licenses vary by locality. Call the clerk at (540) 261-8627 to confirm the current fee before your visit.

There are two ways to get a certified copy of a Buena Vista marriage record. If the marriage took place from 1936 forward, you can request one from VDH. If it happened before 1936, you need to go to the Rockbridge County Circuit Court Clerk. Both offices charge a fee. VDH charges $12 per copy. The clerk's office may charge a different amount. Ask when you call.

To request from VDH, you need to fill out the Application for Certification of Vital Record (form VS6). You must show valid ID or include a copy of one with your mail request. VDH accepts mail requests sent to their office at 2001 Maywill Street, Suite 101, Richmond, VA 23230. You can also request online through their portal at vdh.virginia.gov. Processing times vary. Mail can take a few weeks. In-person visits are faster.

Under Virginia Code § 32.1-271, marriage records become public after 25 years. Records less than 25 years old are restricted to the individuals named in the record, their immediate family, or those with a legal need. This applies whether you request from VDH or the local clerk.

The Library of Virginia also holds older marriage records and can be a valuable resource for genealogical research into Buena Vista and Rockbridge County marriages.

Virginia Marriage Record Laws

Virginia law sets the rules for how marriage records are issued, stored, and accessed. Under Virginia Code § 20-14, circuit court clerks are the official issuers of marriage licenses across the state. Under Virginia Code § 32.1-267, records of all marriages must be filed with the state registrar. These two statutes define the basic framework for marriage records in Buena Vista and every other Virginia jurisdiction.

Access to these records follows Virginia Code § 32.1-271, which restricts marriage records for the first 25 years. After that point they become open to any member of the public. The fee for a certified copy is capped at $12 under Virginia Code § 32.1-273. If you are denied access to a record you believe should be public, the Virginia FOIA Council can advise you on your rights under Virginia Code § 2.2-3704.
